Terms of Service

These Terms of Service ("Terms") govern your use of boumiza.com, its subdomains including clearpath.boumiza.com, nightwatch.boumiza.com, and editorinchief.boumiza.com, and the ExpressDelivery open-source mailbox application (collectively, the "Services"). By accessing or using the Services you agree to be bound by these Terms.

1. Acceptance

If you do not agree with any part of these Terms, do not use the Services. Your use of the Services constitutes acceptance of these Terms and of the Privacy Policy referenced within.

2. Eligibility and Accounts

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Services. Admin accounts are issued to the site owner and designated collaborators; creation of other accounts is not generally available and is at our sole discretion. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

3. Permitted Use

You agree to use the Services only for lawful purposes and in a manner that does not:

  • Violate any applicable law, regulation, or third-party right (including intellectual property, privacy, and publicity rights).

  • Transmit unsolicited commercial messages, malware, phishing content, or any material intended to harm users or infrastructure.

  • Interfere with, disrupt, or impose unreasonable load on the Services (including automated scraping at a rate that degrades performance).

  • Attempt to bypass authentication, rate limits, or access controls, or probe for vulnerabilities without authorization.

  • Impersonate any person or entity, or misrepresent your affiliation.

Responsible security research is welcome; please report findings to security@boumiza.com. Testing that impacts availability for other users is not authorized.

4. Intellectual Property

All content on boumiza.com and its subdomains — including text, graphics, logos, images, audio, video, code, and UI design — is owned by Yassine Boumiza or its licensors and is protected by copyright, trademark, and other laws. You may view the public portions of the Services for personal, non-commercial use. Any other use (reproduction, modification, distribution, creation of derivative works, framing, or scraping for training of machine-learning models) requires prior written permission.

5. User-Submitted Content

When you submit content through a contact form, subdomain product, or other channel, you grant us a non-exclusive, worldwide, royalty-free license to use that content strictly for the purpose of providing, operating, and improving the Services. You retain ownership of your submissions. You represent that you have the right to submit the content and that it does not infringe any third-party right.

6. ExpressDelivery (Open Source)

ExpressDelivery is distributed as open-source software under its stated license (see the project repository). The open-source license governs your right to use, modify, and distribute the software. These Terms govern only your interaction with instances of ExpressDelivery that we operate or with boumiza.com pages about the project.

The software is provided "AS IS" under the terms of its license, without warranty of any kind. Contributions submitted to the ExpressDelivery project via pull request or issue tracker are governed by the project’s contribution terms (Developer Certificate of Origin or equivalent, as stated in the repository).

7. Third-Party Services and Links

The Services may link to or integrate with third-party services (BREVO for email delivery, Hostinger for hosting, GitHub for source hosting, etc.). We do not control these third parties and are not responsible for their content, privacy practices, or availability. Your use of third-party services is subject to their own terms.

8. Availability and Changes

We provide the Services on an "AS IS" and "AS AVAILABLE" basis. We may modify, suspend, or discontinue any part of the Services at any time without liability. We do not guarantee uninterrupted, error-free operation.

9. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, BE SECURE, OR BE FREE OF DEFECTS, ERRORS, OR HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL YASSINE BOUMIZA, HIS AFFILIATES, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED CAD $100.

11. Indemnification

You agree to indemnify, defend, and hold harmless Yassine Boumiza and contributors from any claim, damage, or expense (including reasonable legal fees) arising out of your violation of these Terms, your violation of any third-party right, or your misuse of the Services.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Services ceases immediately; Sections 4, 5, 9, 10, 11, and 14 survive termination.

13. Governing Law

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Any dispute shall be brought exclusively in the courts of Quebec, Canada, unless applicable consumer-protection law provides otherwise.

14. Changes to These Terms

We may revise these Terms from time to time. The "Last updated" date at the top of the public page will reflect the most recent revision. Material changes will be announced on the main site. Continued use of the Services after an update constitutes acceptance of the revised Terms.

15. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our consent; we may assign freely. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Services.
